Platform for Validating Digital Business Ideas Version 2
1. Scope
These Terms of Use govern the contractual relationship between the operator of the platform and registered users.
By registering, subscribing, or using the platform, the user accepts these Terms of Use.
2. Operator

3. Subject Matter
The platform is intended for the structured documentation, management, and analysis of digital business ideas.
In particular, users may store and manage information relating to business ideas, Business Model Canvases, hypotheses, experiments, metrics, thresholds, measurements, and other validation activities.
The platform solely provides a technical tool.
In particular, the platform does not provide:
- legal advice
- tax advice
- financial advice
- business consulting
- investment advice
- strategic consulting
Users are not entitled to any specific features, future developments, enhancements, or future versions of the platform.
4. Development and Testing Status
The platform is wholly or partially in an ongoing development, testing, and improvement phase.
The user expressly acknowledges that:
- features may be incomplete
- features may contain errors
- features may be modified at any time
- features may be removed at any time
- data loss may occur
- errors, interruptions, or security issues may occur
The platform is used entirely at the user's own risk.
5. Registration and User Account
A user account is required to use the platform.
The user agrees to:
- provide accurate information
- keep credentials confidential
- not use accounts belonging to others
- not share their account with third parties
The user is responsible for all activities performed through their account.
6. Acceptable Use
The platform may only be used within the scope of its intended functionality.
The following activities are prohibited in particular:
- unlawful content
- offensive content
- fraudulent content
- abusive use
- circumvention of technical safeguards
- disruption of the platform
- automated mass requests
- scraping
- denial-of-service attacks
- distribution of malware
The operator may restrict, suspend, or permanently delete user accounts at any time, without prior notice and without providing reasons.
7. User Content
The user remains solely responsible for all content stored or entered on the platform.
This includes in particular:
- business ideas
- business plans
- canvas content
- hypotheses
- experiments
- measurements
- metrics
- business information
The operator does not generally review user content for:
- accuracy
- completeness
- legality
- timeliness
- infringement of third-party rights
The user warrants that they possess all necessary rights to the content they store on the platform.
8. Confidential Information
The platform is not intended for the storage of trade secrets or highly sensitive information.
The user alone decides which information is stored on the platform.
The operator assumes no liability for damages resulting from the storage of confidential or business-critical information.
9. Availability
The platform is provided as an online service.
There is no entitlement to:
- uninterrupted access
- continuous availability
- specific response times
- specific performance levels
- data retention
- data recovery
The operator may at any time:
- modify the platform
- restrict the platform
- interrupt the platform
- deactivate the platform
- permanently discontinue the platform
No claims may be asserted against the operator as a result.
10. Data Backup and Data Loss
Users are solely responsible for backing up their own data.
The operator does not provide guaranteed backups of user data.
In particular, there is no entitlement to:
- backup creation
- data recovery
- restoration of deleted accounts
- restoration of deleted content
Data loss may occur at any time.
11. Subscriptions and Payments
The platform may offer paid subscriptions.
Current pricing is published on the platform.
Subscriptions renew automatically for the selected billing period unless cancelled.
Paid fees are generally non-refundable.
Upon cancellation, the user account is immediately downgraded to the free plan.
There is no entitlement to continue using paid features until the end of a billing period that has already begun.
12. Analysis Results and Recommendations
The platform may provide analyses, metrics, visualizations, statistics, or other information.
All such information is provided solely for informational purposes.
The operator makes no warranties regarding:
- accuracy
- completeness
- timeliness
- economic suitability
- business suitability
The platform does not make decisions on behalf of the user.
All decisions remain solely the responsibility of the user.
13. No Guarantee of Success
Use of the platform does not constitute any guarantee or assurance regarding the success of a business idea.
In particular, no guarantee is made that:
- an idea will succeed
- customers will be acquired
- revenue will be generated
- investors will be obtained
- market demand exists
- economic success will be achieved
14. Security
The operator strives to implement reasonable technical and organizational security measures.
However, complete protection against:
- cyberattacks
- security incidents
- software defects
- data loss
- unauthorized access
cannot be guaranteed.
The operator assumes no warranty or liability in this regard.
15. Third-Party Services
The platform may rely on third-party services.
These may include in particular:
- hosting providers
- database providers
- authentication services
- payment providers
- open-source software
- external libraries
The operator assumes no liability for errors, security vulnerabilities, outages, or damages caused by such third parties or their software.
16. Intellectual Property
The platform, including its source code, structure, design, content, and functionality, is protected by intellectual property laws.
Unless expressly permitted by law or by applicable open-source licenses, the following are prohibited:
- copying substantial parts of the platform
- commercial exploitation
- resale
- replication of the platform
- removal of copyright notices
17. Limitation of Liability
Use of the platform is entirely at the user's own risk.
The platform is provided without any express or implied warranties.
To the extent permitted by applicable law, the operator shall only be liable for direct damages caused intentionally.
Any liability for:
- ordinary negligence
- indirect damages
- consequential damages
- data loss
- loss of profit
- loss of revenue
- business interruption
- loss of business opportunities
- investment decisions
- business decisions
- third-party claims
is excluded.
To the extent permitted by law, liability is limited to the fees paid by the user during the twelve months preceding the event giving rise to the claim.
Where the platform is used free of charge, all liability is excluded.
18. Indemnification
The user agrees to indemnify and hold harmless the operator from any third-party claims arising from the user's use of the platform.
This includes claims relating to:
- legal violations
- copyright infringement
- data protection violations
- contractual breaches
- unlawful content
To the extent permitted by law, this also includes reasonable legal defense costs.
19. Account Deletion
Users may delete their account at any time.
Deletion is permanent.
Deleted accounts and content generally cannot be restored.
20. Changes to the Platform
The operator may modify features, pricing, usage limits, subscriptions, or other aspects of the platform at any time.
Users have no entitlement to the continued availability of specific features.
21. Changes to the Terms of Use
The operator may modify these Terms of Use at any time.
The version published on the platform shall be authoritative.
22. Privacy
The processing of personal data is governed by the separate Privacy Policy.
23. Governing Law and Jurisdiction
These Terms of Use shall be governed exclusively by Swiss law.
The place of jurisdiction shall be Kerzers FR, Switzerland, unless mandatory legal provisions provide otherwise.
24. Language Versions
These Terms of Use may be provided in multiple languages.
In the event of discrepancies, conflicts, or interpretation issues, the German version shall prevail.
